EVV Attestations Due January 1

As the January 1 deadline approaches, the state Department of Health (DOH) reminds providers they must submit an Electronic Visit Verification (EVV) Attestation form for personal care services.

The form must be submitted to the eMedNY portal by January 1, 2021 (and annually thereafter).

HCA advises providers to not wait until the end of December since this is not a very simple process.

At its December 1 bi-monthly EVV Technical Assistance call/webinar, DOH reviewed how to complete and submit the attestation form. In addition, DOH recommended that providers review the updated EVV Technical User Guide and Frequently Asked Questions.

The attestation requires providers and fiscal intermediaries (FIs) to acknowledge compliance with state and federal EVV requirements and certify that they: will continue to train staff on EVV; understand their obligations for submitting data to eMedNY, maintaining records and documentation; and are aware they may be subject to government audits or compliance reviews.

Providers and FIs that fail to timely comply with these obligations are at risk for their claims for services being denied and/or the issuance of an overpayment demand letter followed by recoupment procedures. Providers may be also subject to penalties.
