Paid Family Leave Update 

Situation Report | October 11, 2021 

The Workers’ Compensation Board has adopted amendments of the regulations (12 NYCRR 380-2.5(c)) to clarify that when Paid Family Leave (PFL) is taken in increments of one full day, the maximum number of intermittent leave days an employee can take is based on the average number of days they work per week, consistent with the statute. 

The Notice of Proposed Rule Making was published in the May 26, 2021 edition of the State Register. The Notice of Adoption was published in the October 6, 2021, edition of the State Register. 

This regulation will take effect January 1, 2022, and will apply to requests for PFL made on or after January 1, 2022.
