State Paid Sick Leave Benefits Available

Starting January 1, 2021, employees at most companies can start taking sick days under the state’s Paid Sick Leave law. 

As a reminder, the law requires sick leave at the following levels, accrued at a rate of at least one hour per every 30 hours worked:

  • Employers with fewer than five employees and a net income less than $1 million must provide workers with up to 40 hours of unpaid sick leave a year. 
  • Employers with five to 99 employees, and those with fewer than five employees and net income of more than $1 million, must provide workers with up to 40 hours of paid sick leave annually. 
  • Employers with 100 or more employees must provide workers with up to 56 hours of paid sick leave per year.

New York City has its own Paid and Safe Sick Leave law.
